Terms of use for Neksus corporate training services

Introduction
Welcome to Neksus. By accessing or using our services, you agree to be bound by these Terms of Service. Please read carefully before using our platform. If you do not agree with these terms, please do not use our services.
1. Definitions
Terms used in this document:
"Platform"
Refers to the neksus.id website, mobile applications, and all digital services of Neksus.
"User"
Any party that accesses or uses the Platform, including client organizations, designated PICs, participants, and facilitators.
"Services"
Corporate training, people development, and other related services provided through the Platform.
"Fasilitator"
Practitioner or instructor assigned to deliver corporate training programs.
"Training Session"
A period of time during which a facilitator delivers a training program to participants, either in person or online.
2. Terms of Use
To use Neksus services, you must:
Minimum Age
Be at least 18 years old or accompanied by a legal parent/guardian. Users under 18 must have parental consent.
Accurate Information
Provide true, accurate, and complete information during registration and throughout service use.
Account Security
Maintain the confidentiality of your account credentials. You are fully responsible for activities on your account.
Legal Compliance
Comply with all applicable laws and regulations in Indonesia.
3. Corporate Training Services
Terms regarding Neksus corporate training services:
Scheduling
Training schedules are agreed between the client organization and Neksus through the Platform. Cancellations must be made at least 24 hours before the session.
Session Duration
Session duration varies by program: 60 minutes (Elementary), 90 minutes (Middle/High School), or 120 minutes (UTBK/Intensive).
Location
Sessions can be held at the client organization location, an agreed venue, or online via video conference.
Tutor Quality
All facilitators go through a selection process. If deemed unsuitable, a facilitator replacement can be requested.
Results Guarantee
Program scope and objectives are agreed in the proposal based on a training needs analysis (TNA).
4. Payment and Refund
Neksus service payment terms:
Payment Methods
We accept bank transfers, virtual accounts, e-wallets (GoPay, OVO, Dana), and credit/debit cards.
Advance Payment
Payment follows the terms agreed in the proposal or purchase order.
Refund Policy
Cancellation and refund terms follow what is agreed in the proposal or service contract.
Session Cancellation
Cancellation less than 24 hours will incur 50% of session fee. No-show without notice will be charged full fee.
Pricing
Prices may change at any time. Price changes do not apply to already purchased packages.
5. User Obligations
As a user, you must:
Respect Facilitators
Treat facilitators with respect and professionalism. Harassment of any kind is not tolerated.
Provide Facilities
For onsite training, provide a conducive and adequate training space.
Communication
Communicate clearly about learning needs, schedules, and feedback.
Attendance
Ensure participants attend every scheduled training session on time.
No Platform Bypass
Direct transactions with facilitators outside the Platform are prohibited. Violations may result in account closure.
6. Facilitator Obligations
Neksus facilitators must:
Professionalism
Provide instruction at the highest professional standards and prepare materials well.
Punctuality
Arrive on time for every session. Repeated lateness may result in sanctions.
Confidentiality
Maintain confidentiality of participant and client organization information and not share with third parties.
Progress Reports
Provide periodic progress reports to parents/guardians.
Background Check
Be willing to undergo identity verification and background check per Neksus procedures.
7. Prohibitions
Users are prohibited from:
Illegal Content
Uploading, sharing, or distributing illegal, offensive, or rights-violating content.
Fraud
Providing false information, impersonating others, or engaging in fraudulent activities.
Spam
Sending spam messages, unsolicited advertisements, or promotional content without permission.
Hacking
Attempting to access systems, data, or other users' accounts without authorization.
Inappropriate Behavior
Engaging in harassment, bullying, or inappropriate behavior toward other users.
8. Intellectual Property
Intellectual property terms:
Neksus Ownership
All content, logos, designs, and materials on the Platform are owned by Neksus or our licensors.
Tutor Materials
Materials created by facilitators for sessions remain the property of Neksus or the facilitator, with a limited license to the client organization for internal use.
Reproduction Prohibition
Reproduction, distribution, or sale of Platform content without written permission is prohibited.
Feedback
Feedback or suggestions you provide may be used by Neksus without compensation obligation.
9. Limitation of Liability
Neksus liability limitations:
"As Is" Service
Services are provided "as is" without any warranties, express or implied.
Learning Outcomes
Neksus does not guarantee specific outcomes. Training impact depends on various factors including participant engagement and organizational support.
Independent Tutors
Tutors are independent contractors, not Neksus employees. We are not responsible for actions beyond our control.
Indirect Damages
Neksus is not liable for indirect, incidental, or consequential damages.
Maximum Limit
Neksus maximum liability is limited to amounts you have paid us in the last 12 months.
10. Service Termination
Service termination terms:
By User
You may close your account at any time through account settings or by contacting customer service.
By Neksus
We reserve the right to suspend or close accounts that violate these Terms without notice.
Termination Effects
After account closure, service access is terminated. Data is retained per privacy policy.
Refund
Remaining balance will be refunded per refund policy, except for closure due to violations.
11. Dispute Resolution
Dispute resolution procedures:
Negotiation
Disputes will first be resolved through direct negotiation between parties.
Mediation
If negotiation fails, disputes will be resolved through mediation in Jakarta.
Arbitration
As a last resort, disputes will be resolved through arbitration under Indonesian law.
Governing Law
These Terms of Service are governed by the laws of the Republic of Indonesia.
12. Changes to Terms
Information about terms changes:
Right to Change
Neksus reserves the right to change these Terms of Service at any time.
Notification
Significant changes will be notified via email or Platform notification.
Acceptance
Continued use of services after changes constitutes acceptance of new terms.
